Subsection (13) is similar to Form 141 (5)

Part 1 Palmer 13th Ed. p.514. Subsection (14) is taken

almost verbatim from Form 102 at p.494 of the same volume

of Palmer, the only practical differences being that the

draftsman has inserted "Provincial" owing to there being

several provincial Governments in China, and has also insert-

ed "or any other Banks" owing to the existence of the Banking

Consortium in China.

These two subsections (13) and (14) are regard

ed by the Bank as essential for its protection under the

special financial and business conditions prevailing in the

Far East.

With regard to subsection (18) of Regulation

3, the Bank agree to the deletion of the words from "or for enlarging the power" to the end.

In April last the Chief Manager of the Bank

wrote to the Honourable the Colonial Secretary stating that

as a result of a then recent conference between Sir Henry

Pollock and the Attorney General, Sir Joseph Kemp, the Bank

desired to have certain amendments made to the draft Ordinan-

ce and requested that the Honourable the Colonial Secretary should send to the Secretary of State the cablegram set forth in his letter, the object of such proposed amendments being to prevent the possibility of any doubts or questions being raised after the passing of the new Ordinance as to the continuity of the incorporation of the Bank as the same

entity.

The Bank hope that this cablegram will receive

the early attention of the Secretary of State.
